1. Agreement to these Terms
These Terms of Use (“Terms”) are a legally binding agreement between you and VitalityIP (“VitalityIP,” “we,” “us,” or “our”) governing your access to and use of the Food For Health mobile application (the “App”), the website at vitalityip.ai (the “Site”), and related support and communications (together, the “Services”).
By downloading, installing, accessing, or using the Services, creating an account, or signing in with Apple or Google, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Services.
We may update these Terms by posting a revised version on this page and updating the date above. Material changes may also be announced in the App or by email. Continued use after the effective date of updated Terms constitutes acceptance, except where applicable law requires a different process.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use the App or create an account. The Services are designed for adults managing their own eating decisions — including people managing a condition, taking medication, avoiding allergens, or simply planning meals more intentionally. The Services are not for children.
The Services are operated from the United States and are offered on an “as is” basis worldwide. We make no representation that the Services are appropriate or available in every jurisdiction. You are responsible for complying with local laws if you access the Services from outside the United States.
3. Description of the Services
Food For Health is a personal meal app that suggests recipes around your body — conditions, medications, allergies, and what you are cooking tonight — then helps you plan the plate and shop. You may set up a health profile, browse a vertical recipe feed, add sides to build a plate, ask plain-language questions, save favorites, plan meals, cook step-by-step, and turn a plate into a shopping list.
What the App is not. The App is not a calorie tracker, not a workout app, not a grocery store or delivery service, and not a clinician. Shopping lists are informational tools; we do not sell groceries through the App unless we later add a feature and update these Terms.
We may change, suspend, or discontinue features, recipe catalog coverage, ranking logic, or platform availability (including iOS and Android) at any time. “Coming soon” store buttons or marketing on the Site do not create an obligation to publish the App in any store or territory.
4. Medical and nutrition disclaimer
THE SERVICES PROVIDE NUTRITIONAL AND INFORMATIONAL GUIDANCE ONLY. THEY DO NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. VitalityIP is not a licensed health care provider. No doctor–patient, clinician–patient, or similar professional relationship is created by your use of the Services.
Recipe ranking, filters, “health points,” answers about medications (including GLP-1 receptor agonists), allergen flags, and assistant responses are generated from information you enter, our catalog, and automated systems. They may be incomplete, outdated, or wrong. They do not replace advice from a physician, registered dietitian, pharmacist, allergist, or other qualified professional.
You are solely responsible for:
- confirming that any meal is safe for your conditions, medications, and allergies;
- reading full ingredient lists and watching for cross-contact if you have a food allergy or intolerance;
- checking drug–nutrient and drug–food interactions with a clinician or pharmacist before changing your diet;
- food safety, storage, cooking temperatures, and handling; and
- seeking emergency care if you have a medical emergency — do not use the App for emergencies.
Unless a separate written business associate agreement applies, the consumer App is not offered as a HIPAA-covered service. See the Privacy Policy for how health profile data is handled.
5. Accounts, Sign in with Apple, and Google Sign-In
You access the App by signing in with Apple or Google. You do not create a separate VitalityIP password. You must use an Apple ID or Google Account that you are authorized to use, and you must keep that third-party account secure.
Sign in with Apple. If you use Hide My Email, we will treat the private relay address (typically @privaterelay.appleid.com) as your email for notices and support. You agree that this address is a valid means of contacting you. We will not require additional personal information solely because you chose Sign in with Apple. If you revoke the App in Apple ID settings or Apple notifies us that consent was revoked or the Apple Account was deleted, we may terminate your App session and you may lose access until you sign in again or create a new account where permitted.
Google Sign-In. We request basic profile information (typically name, email, Google user ID, and optionally profile photo) to operate your account. Your use of Google Sign-In is also subject to Google’s terms. We use Google user data only as described in our Privacy Policy and in accordance with the Google API Services User Data Policy, including Limited Use.
You are responsible for activity that occurs under your account. Notify us promptly at privacy@vitalityip.ai if you believe your account was accessed without authorization.
One person may maintain one consumer account unless we approve otherwise. You may not share your account. You may not impersonate another person or create an account using someone else’s Apple ID or Google Account.
6. Additional terms for the Apple App Store
If you download the App from the Apple App Store, the following terms apply and are intended to satisfy Apple’s Licensed Application End User License Agreement requirements:
- These Terms are between you and VitalityIP only, not with Apple. Apple is not responsible for the App or its content.
- VitalityIP, not Apple, is solely responsible for providing any maintenance and support for the App. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you (if any). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are VitalityIP’s responsibility.
- VitalityIP, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
- In the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, VitalityIP, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim, to the extent required by these Terms.
- You represent and warrant that you are not located in a U.S.-embargoed country or on any U.S. government list of prohibited or restricted parties.
- You must comply with applicable third-party terms when using the App (for example, your wireless data agreement).
- Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
Your license to use the iOS App is non-transferable and limited to a Licensed Application for use on Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing if Apple’s rules allow.
7. Additional terms for Google Play
If you download the App from Google Play, these Terms are between you and VitalityIP only, not with Google LLC or its affiliates. Google is not responsible for the App, its content, maintenance, or support. Your use of Google Play is subject to the Google Play Terms of Service.
If the App allows account creation, you may request deletion of your account and associated data in the App and via the web pathway described in our Privacy Policy — Account deletion. Google Play’s Data safety section is a summary; this document and the Privacy Policy control the detailed legal terms.
8. AI features
The App may include search and an AI cook/nutrition assistant that responds to plain-language questions (for example, “something high protein under 30 minutes” or “is this okay for GLP-1s?”). Responses may be generated by automated models, including third-party model providers acting as our processors.
AI outputs can hallucinate, omit allergens, misread medications, or conflict with your clinician’s advice. You agree that you will not rely on AI output as a substitute for professional judgment, food-label reading, or emergency care. We may rate-limit, log, or refuse prompts that appear abusive, illegal, or unsafe.
9. License and intellectual property
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the App on devices you own or control, and to access the Site, solely for your personal, non-commercial use.
The Services, including recipes presented in the catalog (except User Content), software, models, ranking logic, text, graphics, logos, and trademarks (including VitalityIP and Food For Health), are owned by VitalityIP or its licensors and are protected by intellectual property laws. Except for the limited license above, no rights are granted.
You may not copy, modify, reverse engineer, decompile, scrape, or create derivative works from the Services except to the limited extent that applicable law prohibits these restrictions. You may not use our trademarks without prior written permission.
10. Your content
You retain ownership of information you submit, including health profile entries, favorites, meal plans, shopping lists, and assistant chats (“User Content”). You grant VitalityIP a worldwide, non-exclusive, royalty-free license to host, process, transmit, display, and create operational copies of User Content solely to provide, secure, and improve the Services, as described in the Privacy Policy.
You represent that you have the right to provide the User Content (including any health information) and that it is accurate to the best of your knowledge. You may not upload another person’s health information without legal authority. We may remove User Content that violates these Terms.
11. Acceptable use
You agree not to:
- use the Services for any unlawful purpose or in violation of these Terms;
- impersonate another person or misrepresent your identity or health information in a way intended to defraud;
- attempt to access another user’s account or data;
- interfere with or disrupt the Services, including by introducing malware or overloading our systems;
- scrape, harvest, or bulk-download the recipe catalog or user data without our written consent;
- use the Services to provide clinical care to others or to market the App as a medical device;
- circumvent age, geographic, or security restrictions; or
- use automated means to create accounts or send abusive assistant traffic.
We may investigate and suspend or terminate accounts that violate this section.
12. Store listings, purchases, and “Coming soon”
Marketing pages may show Apple App Store and Google Play buttons before the App is listed. Those buttons do not constitute an offer to sell, a guarantee of availability, or a price. When the App is listed, download and any in-app purchases or subscriptions will be processed by Apple or Google under their terms. VitalityIP does not receive your full payment card number from those stores.
If we later offer paid subscriptions, fees, renewal, and cancellation will be disclosed in the store listing and in the App. Refunds for store purchases are handled by Apple or Google under their refund policies, except where law requires us to assist.
13. Suspension, termination, and account deletion
You may stop using the Services at any time. You may delete your account in the App (when available) or by emailing privacy@vitalityip.ai as described in the Privacy Policy. Deletion removes the account from our records along with associated personal data we are not legally required to keep.
We may suspend or terminate access immediately if you violate these Terms, if required by law, if your Apple or Google sign-in is revoked, or if we discontinue the Services. Provisions that by their nature should survive (including medical disclaimer, intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive termination.
14. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, VITALITYIP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT RECIPES, RANKING, ALLERGEN INFORMATION, MEDICATION-RELATED GUIDANCE, HEALTH POINTS, OR AI OUTPUTS WILL BE ACCURATE, COMPLETE, OR APPROPRIATE FOR YOU, OR THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES; IN THOSE JURISDICTIONS, OUR WARRANTIES ARE LIMITED TO THE MINIMUM PERMITTED.
15. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VITALITYIP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO VITALITYIP FOR THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS (US $50). THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT WHERE SUCH LIMITATION IS PROHIBITED.
16. Indemnification
You will indemnify and hold harmless VitalityIP and its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your User Content, your misuse of the Services, your violation of these Terms, or your violation of any law or third-party right, including providing health information you are not authorized to share.
17. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, excluding its conflict-of-law rules, and by applicable U.S. federal law. Except where prohibited by law (including any non-waivable consumer rights in your place of residence), exclusive jurisdiction and venue for disputes will lie in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.
If you are a consumer in a jurisdiction that prohibits this forum selection, you may bring claims in your local courts to the extent required. Nothing in these Terms limits any non-waivable statutory rights.
18. General provisions and contact
These Terms, together with the Privacy Policy, are the entire agreement between you and VitalityIP regarding the Services and supersede prior agreements on that subject. If a provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization or sale. There are no third-party beneficiaries except Apple as stated in Section 6.
